Once both parties have agreed to resolve their dispute through mediation, we will schedule a session.
As the mediator, I provide a safe and confidential space for both parties to express their concerns, needs, and experiences related to the dispute.
As a neutral mediator, I do not take sides, judge who is right or wrong, or assign blame. Instead, I help both parties identify what is most important to them and negotiate towards a mutually beneficial agreement.
The focus of mediation is on the future and finding a solution that works for both parties.
During the mediation process, parties may have the opportunity to speak with me confidentially in separate sessions called "caucuses." You will decide which information shared in caucus is strictly confidential and will not be disclosed to the other party.
It is not necessary for parties to have attorneys present during mediation, but they may choose to consult with their attorneys before or during the process.
I encourage parties to address and resolve all their disputes during mediation, as it can lead to better mutual understanding and collaboration in the future.
The cost of mediation will depend on the type and value of the dispute. Please contact me for a quote.
Ultimately, the parties play an important role in mediation by negotiating an agreement that is fair and mutually beneficial. As a mediator, I am responsible for ensuring that the discussion remains respectful and constructive throughout the process. If either party or the mediator withdraws their consent to mediate, the process will stop.
